    Desert Rose Bingo Violating UIGEA Laws!?Lipay’s online bingo site Desert Rose Bingo is under investigation followed by federal officials saying the tribe is violating the UIGEA laws, which sites the law over 15 times in the lawsuit. Two court actions were taken against the tribe this week with the state accusing the company of violating the form of Class III gaming in the state.

    According to the State of California real money online bingo is “an imminent threat to the public health, safety, and welfare” of the states resident’s and they it is currently seeking “orders temporarily restraining, and permanently enjoining, the Tribe’s offering and conducting Internet gambling in breach of the Compact and in violation of state and federal law.

    The online bingo site utilizes proxy play software, but the state insists that the technologies used are an electronic duplicate of bingo. State agencies presented their case this week asking for a temp restraining order against the site. Arguments were presented from both sides with tribal council Little Fawn Boland asking for the site to remain open until a trial can be held claiming there would be loss of income and loss of employment for tribal members. US District Judge Antony Battaglia didn’t make a ruling as of yet, he stated he would make his decision soon enough.

    In the meantime while waiting on the judge’s decision, the state went ahead and filed papers against the tribe and site claiming that the tribe is “engaged in the business of betting or wagering”.

    Deputy Attorney General Bill Torngren commented with the old cliche, “if it looks like a duck and quacks like a duck, it’s probably a duck, and an illegal online gambling site.”

    Iipay Nation of Santa Ysabel, “is exerting its sovereign right under the Indian Gaming Regulatory Act (IGA) to regulate and conduct Class II gaming from the tribe’s reservation.”
