Appeals court says no to online poker in Washington

A Renton lawyer’s campaign to make Washington state safe for Internet poker players lost again on Monday.

A state appeals court rejected Lee Rousso’s arguments that a 2006 law that forbids Internet gambling in the state violates the clause of the U.S. Constitution that gives the federal government the right to regulate interstate commerce.

Last May, a King County Superior Court judge also ruled against Rousso on a day that 70 online poker players rallied outside the courthouse.

The unanimous decision by three judges of division I of the appeals court says that Rousso would have to show that policing Internet poker imposes excessive burdens and not worth the state’s commitment to regulating gaming.

“Ultimately, given the importance of the state’s interest in protecting its citizens from the ills associated with gambling, and the relatively small cost imposed on out-of-state businesses by complying…Rousso has failed to meet his burden….”

Rousso said appeals court rejected many of the state’s arguments in the case, so he is leaning in favor of taking the case to the state Supreme Court.

When a King County Superior Court judge ruled against Rousso in May, about 70 poker enthusiasts rallied outside the courthouse. Some said they enjoyed playing online poker in their homes and saw no harm from it.

Rousso said he knows of no prosecutions under the law in the state.

Gambling sites included in Aussie ‘blacklist’

Australia Website Blacklist LeakedA “black list” of Web sites that the Australian government would require ISPs to block has been leaked to Wikileaks and it includes a number of online gambling sites.

The list compiled by the Australian Communications and Media Authority (ACMA) was expected to contain sites that published child pornography. But instead, a good portion of the 2,395 sites on the Wikileaks list includes the home pages of private companies, YouTube videos, a tour operator, dating services and medical practitioners. At least 13 poker Web sites are also on the list, including Full Tilt, Poker Stars and Absolute Poker. WilliamHillCasino.com and GamblingHall.com are other online gambling properties also on the list.

ACMA currently maintains the secret blacklist of sites and provides it to software companies that make Internet filtering programs for parents. If the Australian government adopts proposed legislation to force all Australians ISPs to block access to these sites, Australians will not have access to some of the most popular online gambling sites.

The authenticity of the list is being denied by Senator Stephen Conroy, the Minister for Broadband, Communications and the Digital Economy.

“I am aware of reports that a list of URLs has been placed on a web site. This is not the ACMA blacklist,” Conroy said in a statement posted on his Web site Thursday. “”There are some common URLs to those on the ACMA blacklist. However, ACMA advises that there are URLs on the published list that have never been the subject of a complaint or ACMA investigation, and have never been included on the ACMA blacklist.”

Conroy added that “the leak and publication of prohibited URLs is grossly irresponsible. It undermines efforts to improve cyber–safety and create a safe online environment for children…Under existing laws the ACMA blacklist includes URLs relating to child sexual abuse, rape, incest, bestiality, sexual violence and detailed instruction in crime. No one interested in cyber-safety would condone the leaking of these addresses.”

As an apparent result of leaking the list, Wikileaks itself was added to the blacklist on Monday. Any site linking to Wikileaks can now be fined 11,000 Australian dollars ($7,424.40) a day.

Electronic Frontiers Australia said in a statement that the leaking of the blacklist is a “wake-up call for Australians concerned about secret censorship.”

“The leaking of the list has confirmed some of our worst fears,” said EFA Vice-Chair Colin Jacobs. “This was bound to happen, especially as mandatory filtering would require the list to be distributed to ISPs all around the country. The Government is now in the unenviable business of compiling and distributing a list which includes salacious and illegal material and publicizing those very sites to the world.

“Now that we have seen the list, it is clearly not the perfect weapon against child-abuse it has been made out to be,” Jacobs added. “Many of the sites clearly contain only run-of-the-mill adult material, poker tips, or nothing controversial at all. Even if some of these sites may have been defaced at the time they were added to the list, how would the operators get their sites removed if the list is secret and no appeal is possible?”

Obama: No Stimulus Money For Vegas Casinos

Barack Obama No Stimulus For Las Vegas CasinosA provision related to the federal stimulus bill makes it clear that Las Vegas casinos are not to receive any of the money.

But Nevada Senator Harry Reid has asked for clarification from President Obama, citing that casinos are used to house abused women.

The Democratic majority leader says in a letter sent Friday that the provision is “overly broad” and is discouraging nonprofit groups from applying for stimulus money.

argues that casinos are often the only suitable space for conferences and workshops held by community organizations. He makes reference to a women’s group that often uses casino hotel rooms as transitional housing for victims of violence.

The Senate approved the provision, introduced by Republican Senator Tom Coburn of Oklahoma, last month in a 73-24 vote. Reid voted against the measure, while Nevada Republican Sen. John Ensign supported it.

The Vegas economy, including its casino industry, have been hit especially hard by the recent recession.

Australia Banning Online Poker Sites

australiaIn a leaked report obtained by the website WikiLeaks.com, it was revealed that Australia’s list of 2395 “banned website” stretched well beyond the realm of child pornography and “how to murder” websites that most other civilized nations also deem “inappropriate”.

The Sydney Morning Herald included – among other things – sites pertaining to gay and straight porn, euthanasia, a few Christian websites and some YouTube links.

But most disturbing of all perhaps: The list included banned online poker portals.

“It does look like there will be several online poker and online gambling sites that will soon be blocked at the ISP level by the Australian Government,” suggests the website AintLuck.com.

That said, the Australian government has run into quite a bit of opposition with its plan to block websites.

University of Sydney associate professor Bjorn Landfeldt said the leaked list “constitutes a condensed encyclopedia of depravity and potentially very dangerous material”.

He called it “the concerned parent’s worst nightmare” as curious children would inevitably seek it out.

“It seems to me as if just about anything can potentially get on the list,” Landfelt said.

The blacklist is maintained by ACMA and provided to makers of internet filtering software that parents can opt to install on their PCs.

Colin Jacobs, spokesman for the online users’ lobby group Electronic Frontiers Australia, said the leak was not surprising and would only get worse once the list was sent to hundreds of Australian ISPs as part of the Government’s mandatory internet filtering policy.

He said the Government could be considered a “promoter and disseminator of links to some pretty unsavory material”.

“The list itself should concern every Australian – although plenty of the material is unsavory or even illegal, the presence of sites like YouTube, MySpace, gambling or even Christian sites on the list raises a lot of questions,” he said.

Australian Media Man, Greg Tingle, expressed deep concern over this issue with Gambling911.com.

“Big Brother is at it again. Telling us what’s right, what’s wrong, what to read, what not to, what to look at on the web, what not to, what not to say et al. Given I’m a qualified journalist and speaking out against censorship, I guess I should expect to be arrested next.”

The Minister for Broadband, Communications and the Digital Economy, Senator Stephen Conroy, today condemned the reported leak and publication of a list which includes prohibited internet addresses.

“The leak and publication of prohibited URLs is grossly irresponsible. It undermines efforts to improve cyber-safety and create a safe online environment for children,” Senator Conroy said.

Federal Probe Into Alabama Attorney General’s Office

Alabama Online Gambling InvestigationReports surfaced on Monday that federal prosecutors were investigating Alabama Attorney General, Troy King, along with his possible connections to gambling.

King apparently has threatened to shut down some electronic bingo operations while allowing others to stay in business. He claims to oppose gambling but believes that “some electronic gambling machines are allowed under constitutional amendments that authorized the bingo operations.”

King and Alabama’s Governor, Bob Riley, have butted heads over the issue of gambling in the state, particular in regard to the legality of bingo operations in Alabama.

In last week’s Gambling911.com gambling news, we reported on how Alabama’s conservative Congressmen were looking to block any forms of online gambling in the state.

Prosecutors last week called at least six former employees of King’s office — including three former investigators — before a federal grand jury that met over three days in Montgomery, according to the Birmingham News.

That paper also reported that, “while the grand jury is meeting in Montgomery, home of the U.S. attorney’s office for the Middle District of Alabama, the investigation is being run by prosecutors from the Northern District of Alabama, headquartered in Birmingham and led by U.S. Attorney Alice Martin. Martin attended all three grand jury sessions last week, along with members of her staff.”

…. In other gambling news, CNBC’s Cramer has questioned why it is harder to obtain a gambling license in Vegas then it is to register as an investment advisor.

“If the SEC were a bit tighter with the rules, we might have been spared Bernie Madoff and Stanford Financial,” Tom Brennan of CNBC suggests, and he is probably right.

Cramer also questioned Obama’s “head count” of the SEC increase.

“President Obama, in an attempt to move the federal regulator in the right direction, asked for a 13% headcount increase at the SEC. Cramer thinks that number should be closer to 3,000%,” says Brennan. “Laissez-faire doesn’t work. The last administration proved that. So Washington needs to step up and fill the gaps. If we gave the manpower and political will to regulate the gambling industry, Cramer said, then we should police Wall Street just as heavily.”
