Playboy Poker going out of business
Apparently, porn can be sustained, but poker can not.
According to media reports, online poker room Playboy Poker (www.playboypoker.com) is planning soon to close its doors permanently. Gambling911.com was among the first to report the pending closure.
Customers of the room were recently sent e-mails announcing the closing.
The room, operated by the American porn conglomerate that publishes porno mag Playboy, opened in 2006.
The room was licensed by and operated from the tiny Mediterranean island nation of Malta.
The room never took off, however, likely due to the fact that it did not accept paying customers from the USA.
The ban on American customers was because of the Unlawful Internet Gambling Enforcement Act (UIGEA), a law passed by the U.S. Congress in 2006 that restricted online gambling by Americans.
The closing of the online poker room continues the bad luck that Playboy and its founder Hugh M. “Hef” Hefner have encountered when it chucks its porn roots and attempts to embrace gambling.
Playboy previously opened casinos in London, England and Atlantic City, New Jersey, USA but later closed them down.

Kentucky Loses Online Gambling Domain Name Seizure Case
The online gambling industry has won a Kentucky Court of Appeals decision. That court has ruled that the commonwealth cannot seize over 140 domain names of Internet gambling firms.
The decision was handed down Tuesday afternoon.
Joe Brennan Jr., founder of The Interactive Media Entertainment & Gaming Association, was ecstatic by the ruling.
“This is a huge day for our industry!” he declared.
It is also a huge day for iMEGA, which filed the appeal on behalf of the industry. They were in the process of issuing an official statement following the decision which was handed down shortly before 3 pm EST.
Kentucky Governor Steve Beshear has announced he wanted to shut down 141 illegal Internet gambling sites in the state in an effort to stop unregulated online gaming.
Beshear filed a civil suit against the 141 domain names and was asking a circuit court to force the sites to block access to Kentucky users or give up control of their domain names.
“Unlicensed, unregulated, illegal Internet gambling poses a tremendous threat to the citizens of the Commonwealth because of its ease, availability and anonymity,” Governor Steve Beshear said.
“The owners and operators of these illegal sites prey on Kentucky citizens, including our youth, and deprive the Commonwealth of millions of dollars in revenue. It’s an underworld wrought with scams and schemes.”
A circuit court in Franklin, Kentucky ruled that the commonwealth could seize the domain names. He later granted iMEGA’s Motion to Stay after the appeal was filed.
The decision comes on the same day that President Barack Obama officially entered into the White House. The online gambling sector, reeled by the past administration, is hoping for change on a federal level.
The ruling essentially prevents other states from taking similar actions.
U.S. Decision Favors ‘Skill’ Over ‘Luck’ in Texas Hold’em
The Poker Players Alliance (PPA) has reported an important positive U.S. decision in the “skill vs. luck” poker debate.
Apparently last Friday Pennsylvania Judge Thomas A. James Jr. of Columbia County ruled that poker’s most popular game, Texas Hold’em, is a contest where skill predominates, therefore removing it from the definition of illegal gambling in the state.
John Pappas, executive directror of the PPA, opined that Judge James’s decision sets a valuable legal precedent.
In his ruling, the judge examined the relative merits of the skill vs. chance argument, summarising the call as: “Simply, if chance predominates, Texas Hold’em is gambling. If skill predominates, it is not gambling.”
In the case of Texas Hold’em, Judge James referred to the extensive literature on winning strategies for the game, and quoted a well known poker author’s dictum that “the money flows from the bad players to the strong players.”
The judge went into considerable detail in explaining the “dominant factor tests” traditionally applied to games of skill before reaching the conclusion that, in Texas Hold ‘Em, “It is apparent that skill predominates over chance.”
Judge James was presiding over a case where one Walter Watkins was charged with running a $1-$2 NLHE game out of his garage, with no rake — and only dealer tips — taken. Watkins and his dealer were arrested and detained after an undercover Pennsylvania State Trooper took part in the game in a “sting” or entrapment operation.
Following the judge’s decision the defendant and his dealer were both discharged.
Watkins subsequently told Associated Press reporters: “It’s unfortunate we had to go through all this. We were arrested, taken out of our home. Shackled and spent a night in prison. All for playing poker.”
Peter Campana represented the defendants, while Thomas Leipold served as counsel for the State of Pennsylvania.

PartyGaming Sues Former Owner of Empire Online

Jan. 5 (Bloomberg) –
Livermore “failed to deliver a certain amount of income under an acquisition made three years ago,” John Shepherd, a PartyGaming spokesman, said in a telephone interview. The suit was filed in London Dec. 23, according to court records.
Livermore used to operate as the online gaming company Empire Online until Gibraltar-based PartyGaming bought its gambling business in 2006 for $38 million. It changed its name and became an investment business following the acquisition.
Shepherd said the value of the claim is “six figures.” He declined to give more details.
Livermore is run by Chief Executive Officer Noam Lanir, who also founded Empire Online. Fran Read, the company’s spokeswoman, declined to comment.
PartyGaming is in talks with the U.S. Justice Department to resolve allegations over the company’s past activities in that country, where offshore Web gaming is illegal. The company’s founder, Anurag Dikshit, pleaded guilty in the U.S. to illegal Internet gambling and agreed to forfeit $300 million on Dec. 16.
At the time, the company said it was in talks with the Justice Department on a settlement, adding that any payment it makes would likely be “significantly below” the amount paid by Dikshit. The U.S. banned offshore Internet gaming in 2006.
Will the U.S. Recession Affect Online Casinos in 2009?
