Industry Disputes 60 Minutes Claim That Online Poker Is Illegal
The much anticipated 60 Minutes segment on a highly publicized “insider cheating scandal” (a la a “super user account”) already has the online poker community up in arms before the show even airs – the controversy centering on 60 Minutes claim that online poker is illegal. As Gambling911.com has already reported, the segment will receive extensive viewing thanks to marquee NFL games being shown on CBS that lead into the program. Oh, and then they are also featuring a story on Olympic gold medalist swimmer Michael Phelps, which should help boost ratings further. Because 60 Minutes interviewed a few poker pros who claim to make a living playing the game (some of whom have won substantial amounts), by default the show should steer a percentage of new players to these online poker sites. But what has the poker community up in arms is a promo whereby 60 Minutes is referring to online poker as illegal in the United States. The poker community says otherwise. Gambling911.com is here to report that 60 Minutes and those who claim it is not illegal are half right. It IS illegal to operate an online poker room from the United States for real cash transactions. It is NOT, however, illegal to play online poker for real cash if you happen to live in the United States, with the noteworthy exception of Washington State, which makes it a Class C felony to play poker online. Yes, it’s true. Poker players in the state of Washington could end up serving the same amount of time in prison as a child molester. The way in which Washington passed this law, we are not about to proclaim such a scenario as “far fetched”. Angry readers have already begun commenting on the 60 Minutes website. One person had this to say: “Firstly the fact 60 Minutes begins their story with a sentence that is incorrect, “this 18 billion a year industry is illegal in the US” is very disheartening. Come on 60 Minutes, do some fact checking. That is a MAJOR error that makes your reporting not seem objective.” Another comment: “For a news company that spent four months research a story, at least you could have gotten your basic facts straight. Poker is legal in both Canada and the US. If you take a look at the UIGEA, in the US it is illegal for banks to process credit card transactions from gambling companies. It is really a shame that you are going to broadcast this to a nation with such a poorly researched and wrongly negative view of online poker. I had high hopes for this interview that it would help shame the companies at fault and make the industry safer as a whole. Shame on you, CBS.” Much of the 60 Minutes segment will focus on Absolute Poker, an online poker room that has admitted to being compromised by one of its employees. That site has also compensated those affected by the cheating episode.

Kentucky Attorney General Asks to be Dismissed From Petition
Kentucky Attorney General Jack Conway wants no part in a case involving Governor Stephen Beshear’s attempts to have 141 online gambling domain names removed. On Friday, it surfaced that the Attorney General asked to have his name removed from the Interactive Media Entertainment & Gaming Association’s court filings in this matter.
On Friday it was first reported by Gambling911.com that a forfeiture hearing to have 141 online gambling domain names turned over to the Kentucky commonwealth has effectively been cancelled by the Kentucky Court of Appeals until further notice.
Governor Beshear had filed the complaint using outside legal counsel, primarily a Chicago-based law firm. Effected operators claimed that the matter was not properly brought through the Kentucky legislative process.
From the beginning it was common knowledge that this action was brought without the involvement of Attorney General Jack Conway.
iMEGA.org has been granted a hearing before the Kentucky Court of Appeals to argue its Petition for a Writ of Mandamus.
The Interactive Media Entertainment & Gaming Association represents a few dozen of the 141 businesses affected by this matter.

RTG And Vegas Technologies Looking To Prosper From Microgaming Decision
Microgaming made a major decision that was revealed on Thursday when the company decided they will no longer take any new customers from the United States. Real Time Gaming and Vegas Technologies are two of the companies that look to gain the most from this announcement.
Real Time Gaming powers sites such as BoDog, Cherry Red and Rushmore. Vegas Technologies has their software being used by Online Vegas and Golden Casino, among others. The software companies could be major benefactors of today’s decision by Microgaming.
Sites that use Microgaming will no longer be taking new customers from the United States beginning on Monday, November 10th. The move has sent shock waves through the online gaming community, and some believe it is a political ploy by the company.
“With this new administration coming into power in the U.S., the online gambling issue will be one that will be reviewed. The likely scenario is that the current laws are changed to include legislation to regulate the online gambling industry. Microgaming might feel that by pacifying the U.S. today, they will position themselves for licensing in the future,” said Bradley Strench, an online gaming analyst from the UK.
Microgaming.com is not currently up and running after it was one of the sites that was seized in the Kentucky online gambling domain name case. The company could have decided it was simply easier to move away from the U.S. market for the time being, instead of battling in American courts.
Real Time Gaming and Vegas Technologies have not made any announcement on whether they will follow Microgaming, but as of now they look to be the beneficiaries of the bold move. “I think that other software companies can really take advantage of this situation. The customers are there, it is just a matter of how much these companies want to push the envelope in America,” said Strench.
Others believes that this could be the time for companies who are willing to take a chance. “With everything going on in America right now, any company who takes the stance of continuing to accept new U.S. customers could have it pay off in a big way. The government is in transition and the new regime will be focused on reform, not conviction,” said Brian Avelent, a former lawyer who is now an online gaming consultant.

Microgaming Pulling Out of the US Market
Casino Scam Report has just learned that Microgaming, the largest online casino software developer in the world, is pulling out of the US market as of November 10, 2008.
1. As of Monday, November 10th 2008 they will no longer accept any new registrations from players residing in the USA.
2. All existing players registered in the USA will not be affected by this decision and may continue to play.
All Microgaming groups are going to STOP accepting new players from the US on November 10th. Most operators say they will continue to allow players to play as long as they are signed up before this date while some others plan to remove all US players at some point in time later.

Anti-Online Gambling Crusader Chris Gregoire Wins in Washington
Under Gregoire’s reign, Washington became the first and only state in the union to make betting on the Internet a Class C felony with a punishment equivalent to that of a child molester or repeat drunk driving offender.
Within a few hours of the polls closing Tuesday, Gregoire was declared the winner. She was ahead by 54 percent, compared to Rossi’s 46 percent, in unofficial returns with about 55 percent of the votes counted early Wednesday.
This was a rematch of the 2004 election but, unlike 2004, when Rossi took an early lead on Election Night, Gregoire jumped out front early and hung on, according to Rachel La Corte of the Associated Press.
Gregoire beat Rossi four years ago by the closest percentage margin of any governor’s race in U.S. history – just 133 votes out of about 2.8 million cast, after two recounts and an unsuccessful Republican court challenge.
That loss has been simmering with Republicans for years, and Rossi wasn’t ready to concede this time.
“We saw in 2004 and again in the primary this year that later votes cast and counted trended heavily toward Dino Rossi,” Rossi spokeswoman Jill Strait said in a statement. “If that happens again in this general election the results will change.”
